1. Scope of Services
Aqua Might Pressure Washing provides exterior cleaning services, including but not limited to pressure washing and soft washing of surfaces such as siding, driveways, sidewalks, decks, and patios. The specific services to be performed are outlined in the estimate or agreement prepared for each project. Any additional services not listed in the estimate must be requested and confirmed in writing (via text or email). Additional services may result in added charges, which will be communicated in advance and require written approval before work proceeds. Aqua Might Pressure Washing reserves the right to decline requests that fall outside the scope of our exterior cleaning services.
Services are limited to exterior cleaning and do not include interior cleaning, landscaping, or unrelated maintenance work unless expressly stated in the estimate. The scope of services covers cleaning, not restoration, and results may vary based on the age, condition, or material of the surfaces being cleaned. In the event of any conflict between these Terms and a verbal discussion, these Terms will govern.
2. Estimates
Estimates provided by Aqua Might Pressure Washing are based on the information available at the time of inspection or discussion and are intended as approximations of cost. Once an estimate is accepted by the client, it serves as the agreed price unless adjustments are mutually confirmed in writing (via text or email). Adjustments may be necessary if additional work is requested, or if unforeseen conditions are discovered that were not reasonably identifiable at the time the estimate was given.
All revisions to an estimate will be documented and communicated clearly to ensure mutual understanding before work proceeds. Written estimates supersede any verbal discussions of pricing and are valid for 30 days unless otherwise stated. Aqua Might Pressure Washing reserves the right to withdraw or cancel an estimate entirely if it is determined that the original pricing is inaccurate and the client does not agree to the corrected pricing.
3. Changes to Services and Estimates
Any changes to the scope of services—such as adjustments to specifications, quantities, or schedule—must be requested and confirmed in writing (via text or email) to be valid. Approved changes may result in additional charges, which will be communicated in advance and require client approval before work continues.
Only the written estimate or written amendments issued by Aqua Might Pressure Washing are binding; verbal discussions or informal requests do not alter the scope of work. Aqua Might Pressure Washing is not obligated to perform services that are not explicitly listed in the estimate or agreed to in writing, and reserves the right to decline requested changes that are not feasible.
4. Scheduling
Service dates and times are scheduled in advance and may be adjusted based on availability, weather, or unforeseen circumstances. Appointment times are provided as arrival windows rather than exact start times. Aqua Might Pressure Washing will provide notice when technicians are en route and will communicate promptly regarding any schedule changes.
Services may require more than one visit to the property to ensure completion. Aqua Might Pressure Washing may also visit the property before or after scheduled service dates for purposes of assessment, preparation, or quality review.
5. External Factors and Restricted Access
The ability to perform services may be affected by factors outside the control of Aqua Might Pressure Washing, including but not limited to:
● Limited or unavailable parking.
● Lack of access to a working outdoor water supply.
● Other contractors or vendors working in the same area.
● Construction projects, parties, or events on the property.
● Severe weather conditions.
● Unexpected structural issues or safety hazards.
● Locked gates, barriers, or other restricted access.
● Any other unforeseen conditions that delay or prevent service.
If such conditions prevent work from being started or completed as scheduled, services may need to be rescheduled. When the delay is caused by circumstances within the client’s control—such as lack of water, restricted access, or other listed reasons—a minimum trip charge of $150 will apply. Aqua Might Pressure Washing is not responsible for delays or costs arising from external factors or restricted access. Clients are encouraged to ensure that the property is accessible, safe, and service-ready on the scheduled date.
6. Client Responsibilities
Clients are responsible for ensuring that service areas are accessible and prepared on the scheduled service date. Responsibilities include:
● Providing clear access to all areas requiring cleaning.
● Removing furniture, decorations, planters, and personal belongings from the work area and within approximately 15 feet of the cleaning zone or attached structures.
● Ensuring pets and children remain away from work areas during service.
● Confirming that outdoor water supply and electrical sources are available and in working order.
Aqua Might Pressure Washing is not liable for damage, staining, or loss involving items left in or near the service area. If property is not properly prepared and services must be delayed or rescheduled, a minimum trip charge may apply as described in Section 5.
7. Property Conditions
Aqua Might Pressure Washing is not responsible for pre-existing damage to surfaces or structures, including but not limited to cracks, chips, loose materials, wood rot, oxidized surfaces, or failing paint. Clients are expected to inform Aqua Might Pressure Washing of any delicate or sensitive areas prior to service.
Because pressure washing and soft washing may reveal hidden flaws or deterioration, Aqua Might Pressure Washing may document property conditions with photos or video before services begin. This documentation is for the mutual protection of both parties and does not imply liability for pre-existing issues.
For example, surfaces with heavy oxidation (such as faded siding) may show visible spray patterns or water marks after cleaning. These effects are the result of the pre-existing condition, not the cleaning process, and Aqua Might Pressure Washing cannot be held responsible for such outcomes. Oxidation itself is not removed under normal cleaning services and requires a separate, premium oxidation-removal process at a significantly higher cost.
8. Water and Electrical
Usage Aqua Might Pressure Washing requires access to an on-site water supply (garden hose hookup) and, when necessary, an electrical source to complete services. These utilities must be turned on, in working order, and reasonably accessible prior to the scheduled service date.
If water or electrical access is unavailable and services must be rescheduled, a minimum trip charge of $150 will apply as outlined in Section 5. Aqua Might Pressure Washing does not provide compensation for the use of client utilities.
For reference, the use of metered water during a typical service generally costs the property owner less than $10 under average municipal water rates in most areas. The cost of this water usage is the sole responsibility of the client and not Aqua Might Pressure Washing.
9. Removal and Replacement of Property Items
Clients are responsible for removing grills, furniture, planters, decorations, and any other items from the cleaning area prior to service. Aqua Might Pressure Washing is not liable for damage, breakage, or storage issues involving items left in the work area.
If Aqua Might Pressure Washing agrees to move items in order to complete the service, a minimum handling charge of $100 will apply, with additional charges possible depending on the time and labor required. These charges will be communicated in advance.
Aqua Might Pressure Washing also reserves the right to decline moving any items altogether and to refuse work in areas where items have not been removed. In such cases, the related portion of service may be excluded from the work order without penalty to Aqua Might Pressure Washing.
10. Plant Protection
Aqua Might Pressure Washing takes reasonable precautions to minimize the impact of cleaning solutions on plants and landscaping. Despite these efforts, certain vegetation may still be affected by overspray, runoff, or exposure to cleaning agents. Aqua Might Pressure Washing is not liable for any damage to plants, grass, trees, or landscaping as a result of the cleaning process.
Clients can help protect their property by moving potted plants away from service areas and ensuring that nearby landscaping is adequately watered prior to service. Plant damage may also result from pre-existing health conditions, heat, or sun exposure, and Aqua Might Pressure Washing cannot be held responsible for such outcomes.
During roof washing, it should be expected that some level of plant or grass damage will occur due to unavoidable chemical runoff. By requesting roof washing services, the client acknowledges and accepts that such damage is a normal and inherent part of the process.
11. Paint and Surface
Damage Pressure washing and soft washing may result in paint chipping, peeling, or discoloration, especially on older, deteriorated, or previously damaged surfaces. Aqua Might Pressure Washing takes precautions to minimize such outcomes, but clients should understand that these risks are inherent to the cleaning process.
Examples of common issues include:
● Paint or stain failure on weathered or previously oxidized siding.
● Discoloration from the removal of surface chalking or oxidation.
● Exposure of bare material where thin or failing paint layers wash away.
Aqua Might Pressure Washing is not responsible for paint damage, peeling, chipping, or discoloration caused during cleaning, including effects from the use of cleaning solutions. If repainting, refinishing, or other corrective work is required after cleaning, it is the sole responsibility of the client to arrange and cover those costs.
12. Paint and Surface Damage
Pressure washing and soft washing may result in paint chipping, peeling, or discoloration, especially on older, deteriorated, or previously damaged surfaces. Aqua Might Pressure Washing takes precautions to minimize such outcomes, but clients should understand that these risks are inherent to the cleaning process.
Examples of common issues include:
● Paint or stain failure on weathered or previously oxidized siding.
● Discoloration from the removal of surface chalking or oxidation.
● Exposure of bare material where thin or failing paint layers wash away.
● Streaking, fading, or uneven appearance where organic paint pigments have been used.
Clients are responsible for disclosing if organic or non-standard paint pigments have been applied to surfaces. Aqua Might Pressure Washing is not liable for streaking, discoloration, or pigment failure caused by such paints. In cases where neither party is aware that organic pigments were used, responsibility and liability remain with the client.
Aqua Might Pressure Washing is not responsible for paint damage, peeling, chipping, or discoloration caused during cleaning, including effects from the use of cleaning solutions. If repainting, refinishing, or other corrective work is required after cleaning, it is the sole responsibility of the client to arrange and cover those costs.
13. Mortar and Concrete
Pressure washing and soft washing may cause loosening, flaking, or removal of mortar, grout, or concrete, particularly on older or deteriorating surfaces. Aqua Might Pressure Washing is not liable for any damage to mortar or concrete that occurs during the cleaning process.
Clients are responsible for disclosing any known weaknesses, including loose mortar joints, crumbling concrete, cracks, or areas showing signs of spalling or efflorescence. If these conditions are not disclosed and damage occurs, responsibility and liability rest solely with the client.
Clients must also disclose the age of any concrete requested for cleaning. Newly poured or relatively young concrete is especially vulnerable to etching, streaking, or surface damage
during washing. If newer concrete is cleaned at the client’s request, the client accepts full responsibility for any resulting damage.
Where risks are disclosed, Aqua Might Pressure Washing may take steps to minimize disruption; however, mitigation is not a guarantee, and damage or further deterioration may still occur. Any repairs, replacements, or restoration required after cleaning remain the responsibility of the client.
14. Water Streaks on Windows
Despite reasonable precautions, water streaks or spotting may occur on windows after pressure washing or soft washing. Factors such as delayed drainage from ledges, weather conditions, mineral content in water, or existing dirt and debris on window screens can contribute to streaking.
Aqua Might Pressure Washing will make reasonable efforts to minimize these effects through thorough rinsing; however, we cannot guarantee completely streak-free windows in all circumstances. Occasional streaks or water spots are a normal outcome of exterior washing and do not constitute a deficiency in service. Professional window cleaning is a separate service and is not included as part of standard washing. Aqua Might Pressure Washing is not liable for water streaks, spots, or related cosmetic issues on windows.
15. Color, Tone, and Surface Conditions
The color, tone, and appearance of cleaned surfaces will vary based on age, material, and pre-existing conditions. These variations are natural and do not reflect a deficiency in service. Aqua Might Pressure Washing is not liable for dissatisfaction related to natural differences or limitations of the cleaning process.
● Wood: Different species, densities, and levels of weathering may cause boards to appear lighter, darker, or uneven in color after washing. Stains or finishes may also react differently, and tannin bleed or sun-faded areas may remain visible. Clients with concerns should disclose them prior to service. Aqua Might Pressure Washing is not responsible for color changes or tonal variations that clients find unsatisfactory.
● Concrete: Variances in color and tone are common due to age, depth of organic staining, prior treatments, or other conditions. Some discoloration may remain even after cleaning. Clients should expect some degree of variance in the final finish. Newer concrete is especially vulnerable to etching or streaking, and clients are responsible for disclosing the age of concrete before cleaning. Any damage or discoloration resulting from cleaning newer concrete is the sole responsibility of the client.
● Siding: Many types of siding (particularly vinyl and aluminum) naturally oxidize over time, leaving a chalky residue. Standard washing does not remove oxidation, and cleaning may cause existing oxidation to appear streaked or uneven. Full oxidation removal requires a separate premium service and is not included in normal washing. Stains from sprinkler systems, irrigation overspray, or well water often contain minerals,
rust, or other deposits that do not fully wash away with standard cleaning. These stains may remain visible after service unless a specialty treatment is requested.
Clients are responsible for disclosing any known conditions, such as oxidation, organic paint pigments, irrigation residue, or newer concrete, prior to service. In all cases, repainting, refinishing, or restoration work required after cleaning remains the sole responsibility of the client.
16. Expectations of Results
Exterior cleaning improves the overall appearance of a property but is not a restoration service. Final results will vary depending on the material, age, and condition of the surface. Surfaces may appear lighter, darker, or otherwise different than anticipated, and some staining or discoloration may remain even after thorough cleaning.
Aqua Might Pressure Washing aims to deliver the best possible results; however, complete restoration of original color, finish, or uniformity is not guaranteed. Dissatisfaction with natural variations in outcome does not constitute a deficiency in service, and Aqua Might Pressure Washing is not liable for results that do not match a client’s personal expectations.
17. Courtesy and Safety
A safe and undisturbed work environment is essential during exterior cleaning services. To help maintain safety:
● Children, pets, and visitors should remain clear of all work areas while services are being performed and for at least 24 hours afterward.
● Surfaces may remain wet, slippery, or chemically treated during this period. Clients who enter the work area before surfaces are fully dry do so at their own risk. Aqua Might Pressure Washing is not liable for slips, falls, or injuries that occur as a result of entering treated or wet areas prematurely.
● Clients should avoid scheduling other contractors or activities in the immediate service area during cleaning.
These precautions help ensure safety for all parties and allow Aqua Might Pressure Washing to complete services efficiently and effectively.
18. Warranty
Aqua Might Pressure Washing stands behind the quality of its workmanship. If concerns arise regarding workmanship, clients must notify Aqua Might Pressure Washing in writing (via text or email) within 5 days of service completion. Aqua Might Pressure Washing will review the concern and, if warranted, take appropriate corrective action.
If Aqua Might Pressure Washing chooses to provide a remedy—whether or not Aqua Might is responsible for the condition in question—such remedy will be completed within 10 days of the written notice. The decision to remedy any situation is at the sole discretion of Aqua Might Pressure Washing and does not imply or assign responsibility, liability, or fault.
In the event that damage occurs due to negligence or misconduct on the part of Aqua Might Pressure Washing (for example: improper use of equipment causing surface damage, failure to follow industry-standard practices, or disregard of disclosed property conditions), Aqua Might Pressure Washing reserves the right to provide a resolution. Such resolution will be considered satisfactory if it restores the property to equal condition or better.
If Aqua Might proposes a resolution in writing, the client has 10 days to respond. Failure to respond within this period will be treated as a decline of the resolution. If the client declines or refuses the resolution, the client assumes all responsibility for arranging and covering the cost of replacement, repair, or restoration.
This warranty applies only to workmanship and does not cover conditions outside the control of Aqua Might Pressure Washing, including but not limited to oxidation, plant damage, pre-existing surface failures, discoloration, or results that do not meet subjective client expectations.
19. Payment Terms
Payment for services is due in full upon completion of the job, unless otherwise agreed in writing in advance. Aqua Might Pressure Washing accepts payment by card, electronic invoice, cash, or check.
● Grace Period: In accordance with Delaware law, clients are allowed a grace period of 5 days from the due date before any late fees or interest are applied. If Aqua Might Pressure Washing is located outside the client’s county, an 8-day grace period applies.
● Late Fees & Interest: After the applicable grace period, unpaid balances will accrue interest at a rate not exceeding 5% per month, calculated and applied daily. For example, on an overdue balance of $100, daily interest would accrue at approximately $0.17 per day until the balance is paid in full.
● Returned Payments: Any returned checks or failed payment transaction will incur a $35 processing fee in addition to the outstanding balance.
● Deposits: For certain projects, Aqua Might Pressure Washing may require a deposit, which will be applied toward the final balance.
● Collections: Unpaid balances may be pursued through collection efforts or legal remedies. Aqua Might Pressure Washing reserves all applicable lien rights permitted by law.
Timely payment helps ensure efficient scheduling and continued service availability.
20. Cancellation Policy
Clients may cancel or reschedule services by providing at least 24 hours’ notice prior to the scheduled service time. Notice must be given in writing (via text or email) to ensure proper recordkeeping.
If less than 24 hours’ notice is provided, a $150 cancellation fee will apply, consistent with the minimum trip charge outlined in Section 5. Aqua Might Pressure Washing reserves the right to waive this fee at its sole discretion in the case of emergencies or extenuating circumstances.
21. Liability Waiver
Aqua Might Pressure Washing takes all reasonable precautions to ensure the safety of its team members, clients, and property during service. However, Aqua Might Pressure Washing cannot accept liability for damages, losses, or injuries that occur in the course of providing services, except in cases of proven negligence or intentional misconduct.
For clarity, the following do not constitute negligence:
● Natural risks and outcomes identified in these Terms (including but not limited to oxidation, plant damage, paint chipping or peeling, mortar deterioration, water streaks, and color/tone variations).
● Pre-existing conditions or undisclosed property issues.
● Damage resulting from client failure to follow safety precautions (such as entering wet or treated surfaces prematurely).
● Damage to clothing or personal belongings exposed to cleaning solutions. Aqua Might Pressure Washing’s cleaning solutions can permanently stain or discolor normal clothing and fabrics. Clients and their guests are responsible for avoiding treated areas and for ensuring that appropriate protective clothing is worn if entry is necessary.
● Chemical exposure to people or pets that occurs due to entering the work area before it is deemed safe. Clients are responsible for ensuring that pets, children, household members, and any guests are kept clear of service areas until surfaces are dry and safe.
Examples of negligence or misconduct may include, but are not limited to:
● Using high pressure or improper techniques on surfaces that should have been soft washed.
● Failing to follow industry-standard practices in the application of cleaning solutions.
● Reckless operation of equipment that results in avoidable property damage.
● Intentional misuse of chemicals or equipment in a manner inconsistent with safety protocols or industry standards.
By scheduling services, clients acknowledge and accept the inherent risks of exterior cleaning and agree that liability rests solely with Aqua Might Pressure Washing only where negligence or intentional misconduct is established.
22. Industry Standards
For the purposes of these Terms, “industry standards” refer to widely accepted best practices for exterior cleaning, including the use of equipment and solutions appropriate to each surface type:
● Soft Washing Solutions: Cleaning agents are applied at low pressure to allow the solution to dwell on the surface for safe, effective organic removal. Solutions are mixed and applied according to manufacturer guidelines and industry practice, with rinse methods used to minimize damage to property and vegetation.
● High Pressure Equipment: Pressure washers are used at levels appropriate to the material being cleaned. High pressure methods are reserved for durable hard surfaces (such as concrete, brick, and stone) and are not applied to delicate or damage-prone surfaces such as siding, shingles, windows, or painted finishes.
These definitions are intended to clarify that Aqua Might Pressure Washing follows accepted professional standards when performing services. Variations in outcome do not indicate negligence when services are performed consistent with these practices.
23. Communication Consent
By requesting or receiving services from Aqua Might Pressure Washing, clients consent to receive communications via text, email, or phone regarding scheduling, service updates, billing, and follow-up. Clients are expected to provide timely and clear responses to communication so services may be performed efficiently.
Aqua Might Pressure Washing respects client privacy and will not sell, share, or misuse personal information. Communication will be limited to service-related matters and occasional follow-ups, unless the client provides explicit consent to receive marketing or promotional materials.
24. Media Release
Aqua Might Pressure Washing may capture photos or videos of completed work for use in marketing, training, or promotional materials. These images will focus solely on the property or service performed.
Aqua Might Pressure Washing will not disclose client names, addresses, or other personally identifying information without prior consent. Clients who prefer not to have images of their property used for marketing may request exclusion in writing prior to service.
25. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable, such provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall continue in full force and effect. The intent of the original provision will be preserved as closely as possible in a manner consistent with applicable law.
26. Entire Agreement and Governing Law
These Terms constitute the entire agreement between the client and Aqua Might Pressure Washing and supersede all prior discussions, negotiations, communications, or agreements, whether written or verbal, regarding the subject matter herein.
No amendment or modification of these Terms shall be valid unless made in writing and agreed to by Aqua Might Pressure Washing.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Delaware, which shall have exclusive jurisdiction.
27. No Waiver
Failure of Aqua Might Pressure Washing to enforce any provision of these Terms at any time shall not be construed as a waiver of the right to enforce that provision or any other provision in the future. Aqua Might Pressure Washing reserves all rights not expressly granted herein.
28. Right to Refuse or Reschedule Service
Aqua Might Pressure Washing reserves the right to delay, reschedule, or refuse service if safe, reasonable, and timely access to the work area is not available. This includes, but is not limited to, lack of water or electricity, obstacles blocking work areas, presence of contractors or pets, or unsafe site conditions. In such cases, a minimum trip charge of $150 may apply as outlined in these Terms.
In addition, Aqua Might Pressure Washing reserves the right to
refuse service or cancel a contract at its sole discretion for any reason, provided such refusal or cancellation is not based on unlawful discrimination or in violation of applicable law. If Aqua Might Pressure Washing cancels a contract without cause, any deposit or unearned portion of payment collected in advance will be refunded to the client.
